Welcome to Swvle.
These Terms of Service ("Terms") govern your access to and use of the Swvle website, software, AI-powered services, APIs, widgets, and related products (collectively, the "Services").
By accessing or using Swvle, you agree to these Terms.
If you are using Swvle on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, please do not use the Services.
2. Definitions
To make these Terms easier to read, we use the following definitions throughout this document.
Swvle
The Swvle platform, website, software, AI services, widgets, APIs, and related services.
Services
All products and services provided by Swvle.
Organization
A business, sports team, university, municipality, nonprofit, government agency, or other entity using Swvle.
Workspace
An organization's private area within Swvle used to configure and manage its AI experiences.
User
Anyone accessing or using the Services, including visitors, registered users, workspace members, and end users interacting with a Swvle-powered experience.
Swvle Account
A personal account that allows a user to access Swvle services and may be used across multiple participating organizations.
Content
Information submitted to or managed through Swvle, including documents, messages, images, knowledge bases, prompts, and other materials.
3. About Swvle
Swvle provides an AI-powered conversation and engagement platform that enables organizations to create branded conversational experiences for customers, fans, visitors, members, employees, and communities.
Depending on how you use Swvle, you may interact with the Services as:
- A website visitor
- A registered Swvle user
- An end user interacting with a Swvle-powered experience
- A workspace member
- A workspace administrator
- An organization customer
4. Eligibility
To use Swvle, you must:
- Be legally able to enter into this agreement.
- Use the Services in compliance with applicable laws.
- Provide accurate account information when requested.
- Keep your account information reasonably up to date.
Organizations are responsible for users they authorize to access their workspaces.
5. Swvle Accounts
Some Swvle-powered experiences may be used without creating an account.
Creating a Swvle account may enable additional features, including:
- Saved conversations
- Personalization
- Conversation history
- Cross-device access
- Membership in multiple organizations
- Organization-specific experiences
You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.
6. Privacy
Your privacy is important to us.
Our collection, use, and protection of personal information is described in our Privacy Policy.
By using the Services, you acknowledge that information may be processed as described in that policy.
7. Organization Workspaces
Organizations may create one or more workspaces within Swvle.
Workspace administrators manage:
- Users and permissions
- Branding
- AI configuration
- Knowledge bases
- Organization settings
- Engagement campaigns
- Workspace content
Organizations are responsible for managing access to their workspaces and ensuring that authorized users comply with these Terms.
8. Acceptable Use
You agree not to use Swvle to:
- Violate applicable laws.
- Harass, threaten, or abuse others.
- Upload malicious software.
- Attempt unauthorized access.
- Interfere with the operation of the Services.
- Circumvent security measures.
- Infringe intellectual property rights.
- Submit unlawful or harmful content.
- Use the Services for fraud or deception.
- Abuse or intentionally misuse AI capabilities.
Swvle may suspend or terminate accounts that violate these Terms or that create risk for the platform or other users.
9. Content Ownership
Customer Content
Organizations may upload or create content including:
- Knowledge bases
- Documents
- Images
- Videos
- Websites
- Branding
- AI prompts
- Engagement campaigns
- Other organization content
Organizations retain ownership of their content.
Organizations are responsible for ensuring they have the necessary rights to use and upload their content.
Swvle receives only the rights necessary to host, process, index, retrieve, display, and otherwise provide the Services.
User Content
Users may submit:
- Questions
- Messages
- Feedback
- Files
- Images
- Other content
Users retain ownership of the content they submit.
By submitting content, users grant Swvle the limited rights necessary to operate and improve the Services requested by the user or organization.
10. AI Services
Swvle uses artificial intelligence, retrieval systems, knowledge bases, and search technologies to power conversations and related platform features.
AI-generated responses:
- May contain inaccuracies.
- May become outdated.
- May not always reflect the latest information.
- Should not be considered legal, medical, financial, or other professional advice.
Users should independently verify important information.
Organizations are responsible for configuring their AI experiences and determining whether AI-generated responses are appropriate for their intended use.
11. Intellectual Property
Swvle owns all rights, title, and interest in the Services, including:
- Software
- APIs
- User interfaces
- Documentation
- Platform technology
- Branding
- Logos
- Trademarks
Except as expressly stated in these Terms, no ownership rights are transferred to users or organizations.
12. Third-Party Services
Swvle may integrate with or rely upon third-party services to operate the platform.
Third-party services may have their own terms and privacy policies.
Swvle is not responsible for services or content outside its control.
13. Availability and Updates
We continually improve Swvle.
We may:

- Modify features
- Remove features
- Perform maintenance

While we strive to provide reliable service, uninterrupted availability cannot be guaranteed.
14. Fees and Subscriptions
Certain Services require a paid subscription.

Organizations are responsible for applicable taxes unless otherwise stated.
15. Suspension and Termination
Swvle may suspend or terminate access if:

Organizations may discontinue using the Services at any time, subject to applicable subscription agreements.
16. Disclaimers

To the fullest extent permitted by law, Swvle disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of Liability
To the fullest extent permitted by law, Swvle will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use of the Services.
Nothing in these Terms limits liability where such limitations are prohibited by applicable law.
18. Indemnification
Organizations agree to defend, indemnify, and hold harmless Swvle from claims arising from:
- Customer Content
- Violations of these Terms
- Violations of applicable law
- Infringement of third-party rights
19. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, we will update the effective date and provide notice where required by applicable law.
Your continued use of the Services after those changes become effective constitutes acceptance of the revised Terms.
20. Governing Law
These Terms are governed by the laws specified in your applicable agreement or, if none is specified, the laws of the State of New York, without regard to conflict of law principles.
